Trump administration plans to end lottery for 85,000 worker visas

NEWYORK: – The Trump administration plans to publish proposed rules that would end or significantly change the annual 85,000 H-1B worker visa lottery. Towards the end of Donald Trump’s first term, the Trump administration proposed ending the lottery process for selecting workers for H-1B visas. Instead, the lottery would be used to award H-1B visas based on the highest to lowest salary.

The Office of Management and Budget is reviewing the proposed new rules, which could be approved for publication in the next few weeks. It is not yet clear what the proposed rules will contain.

However, it is stated that the new rules may review whether the lottery system is fair or not.

ccording to the US Department of State’s Bureau of Consular Affairs, nearly 3,500 Nepalis received H-category visas during the Biden administration. During the previous Trump administration, nearly 2,300 Nepalis received H-category visas from the US.

That is, there was a 50 percent increase in the number of Nepalis receiving H-category visas during the Biden administration compared to Trump’s first term.

In fiscal year 2024, 781 Nepalis received H-1B visas. According to data from the US Department of State’s Bureau of Consular Affairs, 781 people received H-1B visas and 288 of their dependents received H-4 visas.

This visa is valid for 3 years and can be extended up to 6 years. After that, the visa holder may have to reapply to stay on this visa. This visa was created under the Immigration Act of 1990.

However, the H-1 visa was created in the United States by the Immigration and Nationality Act of 1952. However, after 1990, H-1A was allocated for nurses and H-1B for others.

A person who wants to come to the US for this visa cannot apply directly online. Only if he has been offered a job by a company in the US, the employer or its representative or its legal professional can apply online. For positions coming through an H1B visa, the beneficiary must have at least a bachelor’s degree or higher, or its equivalent.

The company should confirm that employees generally require a degree or equivalent qualifications for the position.

The beneficiary must have earned a bachelor’s degree or higher from an accredited college or university in the United States. It does not matter if the beneficiary has already earned a degree in the United States and returned home.

Generally, employers and beneficiaries who meet these criteria can benefit from the US H1B worker visa. Applications registered in this way are selected through a lottery. Only applications that are selected are processed.
